Felkers & Grainger Join List of Sixth Circuit Successes

On October 19, 2026, the 6th Circuit Federal Appeals court followed its recent Perry & Cunningham Opinions with Opinions in Felkers v. Kent County and Grainger v. Ottawa County. This was the third unanimous Opinion that found that the Wayside class action paused the legal time limit for people to claim surplus proceeds from their property tax foreclosure. This spate of rulings supports our clients' position that their claims were filed on time.

An excerpt from the Opinion highlights the magnitude of the issues that these cases are litigating: "Ottawa County sold Grainger's property for $392,000 and never returned the difference between Grainger's outstanding taxes and the proceeds of the sale - $370-500 - to Grainger."

The County has retained Mr. Grainger's money since 2013.
