Cunningham v. Allegan Opinion in Sixth Circuit Echoes Perry Decision

On October 5, 2026, the same federal appeals court followed its Perry ruling in a second case, Cunningham v. Allegan County. The Court's unpublished decision supports their recent finding of our clients' claims in Perry v. St. Joseph County. This was another unanimous Opinion that found that the Wayside class action paused the legal time limit for people to claim surplus proceeds from their property tax foreclosure. The Perry and Cunningham Opinions support our clients' position that their claims were filed on time.
